Fayette County Memorial Hospital is being sued for "misdiagnosis" of a patient, by a woman who said her husband died as a result.

A Washington Court House family is suing Fayette County Memorial Hospital and dozens of health care workers. According to the lawsuit, Kimberly Ward, the widow of Christopher Ward, said her husband was misdiagnosed before he died.

Ward says her husband was taken to Fayette County Memorial Hospital in November 2009 with symptoms of those of the H1N1 virus, but he was sent home.

She says her husband was “wrongfully discharged” and was not provided appropriate medical treatment. Ward says her husband later returned to the hospital, was taken by medical helicopter to Mount Carmel West Hospital in Columbus, where he died the next day.

An attorney for Ward said Mount Carmel West has a resident in charge who was unqualified. The lawsuit alleges a cover-up later ensued after Ward's death.

Fayette County Memorial Hospital said that it would not comment on pending litigation. Mount Carmel West officials could not be reached for comment.
